Urban planning policy, construction law and administrative judge

Defined as the law “regulating the use of land” (Article L. 101-3 of the Urban Planning Code), the urban planning law must meet the many different objectives assigned to it by the legislator. environmental protection and the fight against climate change (article L. 101-2). This reconciliation is more subtle because public policy in this area is based on national and local normative sources and often involves divergent interests among applicants, residents, and associations. To meet these challenges, urban planning law has developed original and innovative mechanisms to combat abusive appeals and adapt the office of the administrative judge, sometimes making it a “laboratory” for general administrative litigation. The 2022 edition of the Conseil d’État Judicial Debates will be an opportunity to return to these various questions and the legal, political and economic issues they raise through four roundtables exploring recent case law.
